1 – Object
These Terms and Conditions govern access to and use of the website feirix.com, as well as the purchase of products through the Feirix platform.
2 – Identification
Feirix is responsible for managing the e-commerce platform available at feirix.com.
3 – Scope
These Terms apply to all users and customers who browse or place orders on the platform.
4 – Adult Content and Age Verification
4.1. The Feirix platform sells, among other products, items intended exclusively for an audience over 18 years of age, accessible in the “Adult” section of the website.
4.2. Access to this section requires age confirmation through an age verification mechanism (age gate). By confirming, the user declares, under their sole responsibility, that they are at least 18 years old.
4.3. Feirix reserves the right to restrict or refuse access to and/or the sale of products in this category to users who do not meet the applicable minimum age requirement.
4.4. Products in the Adult section are not eligible for offers, prizes or promotional campaigns aimed at individuals under 18 years of age.
5 – Product Information
Feirix strives to ensure that all information on the site, including descriptions, prices and product images, is accurate and up to date, but does not guarantee the absence of typographical errors or update lapses.
6 – Prices
Prices include VAT at the legal rate in force, unless otherwise stated. They do not include shipping costs, which will be added at checkout.
7 – Payments
Payments are accepted via credit/debit card, MB WAY, PayPal and other options indicated at checkout. Payments are securely processed by certified providers.
8 – Right of Withdrawal and Returns
The customer has the right to withdraw from the contract within 14 days without giving any reason. The period is counted from the date of receipt of the product(s).
To exercise the right of withdrawal, the customer must notify the decision by email to [email protected]. After validation, the customer must return the items in perfect condition, bearing the direct costs of return, unless otherwise indicated.
All payments received will be reimbursed, including standard delivery costs, within a maximum of 14 days after receipt of the returned items.
Addition: When an order is delivered in partial shipments, the right of withdrawal may be exercised per item, and it is not necessary to return all products at the same time. Return instructions will be provided for each shipment, respecting the applicable legal deadlines.
9 – Warranties
All products benefit from the legal conformity warranty of 3 years (except perishable or consumable goods). The warranty covers manufacturing defects and does not cover misuse, negligence or normal wear and tear.
10 – Customer Responsibility
The customer undertakes to provide true and up-to-date information, including a correct and complete delivery address.
11 – User Account
The customer may create an account to facilitate future purchases. Account access is the sole responsibility of the customer, who must keep the credentials confidential.
12 – Privacy and Data Protection
Personal data is processed in accordance with the Privacy Policy available on the site.
13 – Intellectual Property
All content on the site, including texts, images, logos and design, is the property of Feirix or duly authorized third parties and may not be used without prior authorization.
14 – Communications
15.1. Communications regarding orders will be made by email, SMS or telephone.
15.2. The User may receive legal and operational communications from the Service. The User may also receive informational communications about news and campaigns, provided that a valid legal basis exists (consent or legitimate interest), which may be canceled at any time via the “unsubscribe” link included in each communication or by contacting Feirix.
15.3. Feirix undertakes to respect the User’s communication preferences and to maintain simple and accessible opt-out mechanisms.
15 – Technical Updates and Conditions
Feirix reserves the right to change the site layout and configuration, as well as these Terms and Conditions, at any time.
Addition: In the event of relevant changes to these Terms & Conditions, Feirix will publish the updated version on the website and may additionally notify by email registered Users with an active account.
16 – Force Majeure
Feirix shall not be held responsible for delays or failures in performance resulting from events beyond its reasonable control, such as strikes, natural disasters, network failures or governmental decisions.
17 – Deliveries and Shipping
18.1. Orders may be shipped from different Partner Distribution Centers (located in Portugal, Spain, other EU countries and outside the EU), as well as by different carriers. For this reason, your order may be delivered in partial shipments and with different delivery times.
18.2. Delivery times shown at checkout are indicative and are counted in working days from payment confirmation, and may vary depending on destination, product availability and carrier capacity.
18.3. Whenever applicable, tracking information will be provided for delivery monitoring.
18.4. For deliveries outside the European Union, customs duties, local taxes and charges may apply, which are the responsibility of the customer and are not included in the price shown on the website, unless otherwise stated.
18.5. The transfer of risk to the customer occurs at the time of delivery at the indicated address. If the order is returned due to absence of the recipient, incorrect address or failure to collect within the carrier’s deadline, re-shipping costs may apply.
18.6. In the event of visible damage to the package at the time of delivery, the customer must record the occurrence on the courier’s receipt and notify Feirix within 48 hours, attaching photographs of the package and the product.
18 – Shipping from Partner Distribution Centers
19.1. To ensure the best geographic coverage and product availability, Feirix operates with a network of Partner Distribution Centers, responsible for preparing and shipping orders on behalf of Feirix, in accordance with the highest standards of quality and service.
19.2. In certain categories, there may be specific delivery conditions (longer lead times, transport requirements, address limitations). Where applicable, such information will be indicated on the product page and/or at checkout.
19.3. Invoicing, customer service and after-sales management are ensured by Feirix, without prejudice to the necessary logistical coordination with said partners.
19 – Disputes
In case of dispute, the consumer may resort to Alternative Dispute Resolution (ADR) entities identified on the website of the Portuguese Directorate-General for Consumer Affairs.
20 – Limitation of Liability
Feirix is not liable for indirect damages, loss of profit or data resulting from the use of the site or inability to use it.
Additions:
20.x. Feirix is not responsible for delays or non-performance resulting from events beyond its reasonable control, including but not limited to strikes, transport disruptions, traffic restrictions, acts of public authorities, inspections or customs holds, natural events or widespread system failures.
20.y. In cases of deliveries made in partial shipments, responsibility for each item begins at the respective time of delivery, under the terms of section 18.5.
21 – Governing Law and Jurisdiction
These Terms and Conditions are governed by Portuguese law. Any dispute arising shall be submitted to the competent court of the district of Feirix’s registered office.
Addition: The website is available in multiple languages for the User’s convenience; in case of any interpretation conflict between versions, the Portuguese version shall prevail.
