Marketplace Terms

1 – Purpose

These Marketplace Terms govern purchases made on feirix.com from seller shops that sell through the platform, and complement the general Terms & Conditions of the website. In case of doubt, these Terms prevail for purchases from seller shops.

2 – Definitions

• Feirix: the entity that runs the feirix.com platform (the “Operator”).
• Seller shop: the business or sole trader selling products through the platform, identified on the product page, in the cart and in the order as “Sold by”.
• Customer: whoever buys through the platform.
• Offer: the price, stock and shipping conditions with which a shop sells a product.

3 – Role of Feirix

Feirix provides the platform, presents the catalogue and the shops’ offers, processes payments on behalf of the seller shops and provides first-line customer support. When a product is sold by Feirix itself, Feirix is also the seller shop. The list of shops is available on the Shops page.

4 – Responsibilities of the seller shops

Each seller shop is responsible for the products it sells, namely: the accuracy of the information and prices of its offers; stock availability; packing and shipping; issuing the invoice; the legal warranty; handling returns; and compliance with the applicable law, including product safety and consumer rights.

5 – Orders from several shops

An order may include products from different shops. In that case each shop ships its products separately, shipping is calculated per shop and shown in the cart and at checkout, and the customer may receive several parcels on different dates. The purchase contract for each product is concluded between the customer and the respective seller shop.

6 – Prices and payment

Prices include VAT at the applicable rate. Shipping costs are shown before the purchase is completed. The customer makes a single payment to Feirix using the methods shown at checkout; Feirix collects the payment on behalf of the seller shop(s) and later settles their sales.

7 – Shipping and delivery times

Delivery times depend on the seller shop, the origin of the product and the destination, and are shown at checkout. More information in Delivery Times and Shipping Costs.

8 – Right of withdrawal and returns

The customer may withdraw from the contract within 14 days of receiving the product(s), without giving any reason, by notifying [email protected]. Feirix provides the seller shop’s return address. Refunds are made with the same payment method within the legal period of 14 days. See also Shipping & Returns.

9 – Warranty

Products carry the legal conformity warranty applicable to consumer goods, provided by the seller shop. To make a warranty claim, the customer can contact Feirix, which forwards the request to the shop.

10 – Customer support and complaints

Any question about an order can be sent to [email protected] or via WhatsApp; Feirix answers and, when needed, involves the seller shop. Customers may also turn to an alternative consumer dispute resolution body, such as CNIACC – the Portuguese National Centre for Consumer Arbitration (www.cniacc.pt).

11 – Shops’ offers and content

Feirix may refuse, suspend or remove offers that breach the law, these Terms or third-party rights, or that contain incorrect information. The commercial conditions between Feirix and the seller shops are set out in a separate agreement.

12 – Changes and governing law

Feirix may update these Terms; the version that applies is the one published when the order is placed. Portuguese law applies, without prejudice to the mandatory consumer protection rules of the customer’s country of residence.
